OMNI STREET TERMS AND CONDITIONS

This Service is made available by Omni Street Sdn Bhd (“OMNI”) subject to the Terms and Conditions herein (“Terms and Conditions”). You acknowledge that you have read and fully understood these Terms and Conditions prior to your access to and use of the Service. Your activation and use of the Service constitutes your unconditional acceptance of these Terms and Conditions as may be amended by OMNI from time to time. Any person that you allow to access the Service using your Account shall also be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, please do not continue with the registration process or Activation.

OMNI USERS
  1. Use of the service
    1. Buyer may apply for a refund and/or return of a Product purchased on Omni Street by completing the return/ refund slip attached to the parcel (the “Return Air Waybill”) and returning the Product to Seller at any time within fifteen (15) calendar days after the date that Product was first made available for Buyer to take delivery (the “Free Return Period”). Usually, that date would be the date Buyer received delivery of the Product; however, if Buyer did not receive the Product because of Buyer’s absence from the destination address or Buyer’s failure to input the proper destination address, that date would be the date on which delivery attempt was first made.

    2. In addition to the classes of users as stated herein, OMNI may process and disclose your Personal Information to the following classes, but not limited to:

      • Affiliate Partners with OMNI;
      • Persons/Organizations required under law or where disclosure is necessary for the purposes of compliance with applicable laws or in response to relevant authorized requests.

    3. The Personal Information/Data requested by OMNI are mandatory which you must provide and agree to the processing of such Personal Information/Data. Should you decide not to provide any or all of the Personal Information/Data, OMNI will not be able to proceed with the provision of the Services.

  2. Registration
    1. You may access areas of OMNI that require registration by becoming a registered member and creating an account with us. You agree to be responsible for maintaining the confidentiality of your passwords or other account identifiers which you choose and all activities that occur under your account.

      By registering on OMNI, you agree that:

      • Your account and password are personal to you and may not be used by anyone else to access the OMNI;
      • You will not do anything which would assist anyone who is not a registered user to gain access to any registration area of the OMNI; and
      • You will not create registration accounts for the purpose of abusing the functionality of the site, or other users; nor will you seek to pass yourself off as another user.

      You agree to notify us immediately if you become aware any unauthorised use of your password or account identifiers by others.

  3. Registered Users
    1. Each User who has filled out an on-line registration form on the Site by giving its information (such as name and telephone.) is a registered user of OMNI (a "Registered User"). OMNI will establish an account ("Account") for each Registered User and each Registered User is assigned a user alias ("User ID") and password ("Password") for log-in access to its own Account.

    2. You shall be responsible to update the Registration Information to ensure its completeness and accuracy. You acknowledge and agree that OMNI may share your Registration Information with us from time to time. Each User is only entitled to have one (1) verified email associated with his or her OMNI Account. By accepting this agreement, you acknowledge that you have read and agree with the Privacy Policy and consent to our collection, use and disclosure of your Personal Data for the purposes as set out in the Privacy Policy. By clicking the "Agree" button, you are agreed on this email address will be permanently changed and bound with your OMNI account. You will only entitle to have three (3) chances to verify your email address. Please make sure that you have provided a valid email address to get verification link from us.

      Note: If you do not complete the confirmation process above, your email will remain in an unconfirmed state.

    3. If the Registered User is a business entity, you represent that (a) you have the authority to bind the entity to this Agreement; (b) the address you use when registering is the principal place of business of such business entity; and (c) all other information submitted to OMNI during the registration process is true, accurate, current and complete. For purposes of this provision, a branch or representative office will not be considered a separate entity and its principal place of business will be deemed to be that of its head office.

    4. By becoming a Registered User, you consent to authorize OMNI to share such information with other Users.

    5. OMNI may suspend or terminate a Registered User's Account at any time by giving no less than 24-hour notice to the Registered User; provided, however, that notice is not required for such termination if (a) in OMNI's determination, there is any breach of the provisions of this Agreement by the Registered User; or (b) OMNI has reasonable grounds to suspect that such information provided by a Registered User is untrue, inaccurate or is not current or complete, or (c) OMNI believes that the Registered User's actions may cause financial loss or legal liability to such Registered User, OMNI 's other Users, or OMNI or its affiliates.

    6. Notwithstanding Section 3.1 above, OMNI may refuse registration and deny the issuance of an Account and/or web message Account and associated User ID and Password to any User for whatever reason.

  4. Account Validity
    1. Each registered account is available lifetime, so long as you will make ONE (1) transaction of any value within SIX (6) months from the last transaction made. If no transaction make for 6 months, your member account will be auto changed to INACTIVE and all accumulated Omni Coins and Omni Points will be forfeited.

  5. Omni Coins for Users
    1. If you are a user using the OMNI service, you will automatically be a member of the instant rebate & cashback program which is operated by OMNI. Omni Coins is our official virtual reward that is created to reward our users with more savings in their next payment transaction.

    2. Terms & Conditions of Omni Coins

      • Omni Coins is applicable to use for full payment in Omni Store and Bill Payment & Reload transaction in OMNI.
      • All Omni Coins are non-transferable, non-exchangeable and can’t be redeemed for cash.
      • All registered users are entitled to Omni Coins whenever you complete the payment transaction in Omni. The value of Omni Coins earned is based on the percentage (%) of transaction value stated at each merchants/sellers/vendors.
      • Omni Coins may never expire and keep accumulating, so long as you will make ONE (1) transaction of any value within SIX (6) months from the last transaction made.
      • You may check your Omni Coin balance and history under “Transaction History” at Me page in OMNI app.
      • In the event that the Omni Coins cannot be administered and/or is abandoned and/or cancelled and/or discontinued due to any reason, us, without being subject to any form of liability and at its sole and absolute discretion, may decide to cancel, terminate, modify, or suspend the Omni Coins and/or invalidate any entries for the Omni Coins without assigning any reasons thereto and without notice to the participants.
      • We reserve the right to alter, extend or terminate the Omni Coins, or amend the terms and conditions at its sole discretion at any time without prior notice. In case of any disputes directly or indirectly arising from the promotion, the decision of OMNI shall be final.

      These Omni Coins terms & conditions are valid until amended or suspended by us.

  6. Omni Points for Users
    1. If you are a user using the OMNI service, you will automatically be a member of the reward points program which is operated by OMNI. Omni Coins is our official virtual reward that is created to reward our users with redemption of vouchers/products.

    2. Terms & Conditions of Omni Points

      • Omni Points is applicable to use for Vouchers/Products redemption at “Reward” page.
      • All Omni Points are non-transferable, non-exchangeable and can’t be redeemed for cash.
      • All registered users are entitled to Omni Points whenever you complete the payment transaction in Omni. The value of Omni Points earned is based on the percentage (%) of transaction value stated at each merchants/sellers/vendors.
      • Omni Points may never expire and keep accumulating, so long as you will make ONE (1) transaction of any value within SIX (6) months from the last transaction made.
      • You may check your Omni Points balance and history under “Reward” at Me page in OMNI app.

      • We reserve the right to alter, extend or terminate the Omni Points, or amend the terms and conditions at its sole discretion at any time without prior notice. In case of any disputes directly or indirectly arising from the promotion, the decision of OMNI shall be final.

      These Omni Points terms & conditions are valid until amended or suspended by us.

  7. Notice
    1. OMNI reserves the right to modify, update, and/or amend this Terms and Conditions from time to time at its sole and absolute discretion and without prior notice. All modifications, updates or amendments will be notified to all users via the Platform and/or other methods of communication as prescribed by OMNI and by continuing to use the Platform after such modifications, updates or amendments have been posted and/or notified, you shall be deemed to have agreed to and accepted such modifications, updates or amendments.

  8. Your Privacy
    1. The term “personal data” means any information in our possession or control that relates directly or indirectly to an individual to the extent that the individual can be identified or is identifiable from that information such as name, address, telephone number, passport/identification card number, date of birth, email address, gender, race, bank details, credit/debit card details, etc. The types of personal data collected depend on the purpose(s) of collection. We may “process” your personal data by way of collecting, recording, holding, storing, using, disclosing and/or deleting it.

    2. Your personal data may be collected from you during your course of dealing with us in any way or manner including pursuant to any transactions and/or communications made from/with us. We may also collect your personal data from a variety of sources, including without limitation, at any meetings, events, activities, contests, customer satisfaction surveys organised and/or sponsored by us, as well as from publicly available sources such as directories and OMNI’s social media pages, if you follow, like or are a fan of such pages. Further information may also be collected when we exchange communications with you, for example, if you submit a request, file a complaint or contact our support team.

    3. In addition, we may also receive, store and process your personal data which are provided or made available by any third parties whom you have authorised, credit reference/reporting bodies, regulatory and law enforcement authorities, for reasons including delivery of our Service, performance of conditions of agreements and/or to comply with our legal and regulatory obligations.

OMNI STORE

Omni Store is a shopping channel by Omni Street where Buyers will be able to enjoy the rights and privileges described in these Omni Street Terms and Conditions (“Terms”) when purchasing items on Omni Store from any participating offline retail Merchants. If you are a Buyer, you will be deemed to have consented to these Terms when you make purchases on Omni Store. Similarly, if you are a Merchant, you will be deemed to have consented to these Terms by your continued participation in Omni Street. These Terms supplement all other Omni Street Policies.

  1. Omni Store QR Code
    1. User need to scan Merchant QR Code to proceed payment and rewards collection.

    2. User is responsible to ensure Merchant to verify and validate the transaction before leaving the premises. Any failed transaction or merchant who refuse to verify and validate the transaction, user may request to OMNI via the contact at the end of the page. The approval of your request for rewards allocation will be made after the investigation with Merchant.

  2. Omni Store Merchant Terms and Conditions
    1. If you are a Merchant, you should have received a separate written notification from OMNI informing you of your selection to participate in Omni Store. If you decide not to participate in Omni Store at any time, please inform OMNI in writing (refer to the contact info in the end of this Terms and Conditions); otherwise, you will be deemed to have elected to continue your participation in Omni Store and consented to the terms and conditions set out in these Terms.

    2. Each Merchant undertake, represent and warrant that the retail business it offers on Omni Store to Customers are

      • the Products are not
        • Prohibited and Controlled Products;
        • Inadequate Product;
        • Counterfeit Products;
      • Legal
      • Products or Service provided is same as business category registered

    3. If you are found to have offered or sold any Product and Service that violates the aforementioned, Omni Street reserves the right to, at its sole discretion, remove the offending Business from Omni Store, and execute refunds (and any adjustments) to Buyers who have purchased such Product and Service, in which case Merchant agrees to reimburse Omni Street for all such refunds (including any related costs and charges) and authorises OMNI to deduct such amounts from any amounts payable to you or take such other action as deemed appropriate by OMNI at its sole discretion.

  3. User Payment Methods
    1. Omni Store supports THREE (3) payment methods:

      • Omni Coins
      • Cash
      • Omni Pay

    2. Omni Coins is a virtual credit earned by User. User may pay only the full amount of the transaction at Merchant with Omni Coins by scanning the Omni Store Merchant QR Code. OMNI will reimburse the payment to merchant after TWO (2) working days (T+2).

    3. Cash and credit card payment is allowed at Merchant premise. User makes payment directly to Merchant and User to scan the Omni Store Merchant QR Code to request for rewards collection. Merchant validate the User request via Omni Bizz – Merchant App. Due to payment is received by Merchant, Merchant is required to top up Prepaid Credit in Merchant Account for Fee deduction. Merchant is responsible to have sufficient Prepaid Credit available in account.

    4. Omni Pay is the OMNI owned ePay available in Omni Street Site and App. User makes payment by scanning the Omni Store Merchant QR Code and pay directly to OMNI. OMNI will reimburse the payment to merchant after TWO (2) working days (T+2).

    5. OMNI reserves the right to modify, update, and/or amend this Offline Store Terms and Conditions from time to time at its sole and absolute discretion and without prior notice.

  4. Omni Store Services & Fees
    1. OMNI provides a platform for Merchant to offer Retail Business to Buyers, and for Merchants to complete transactions with Buyers. Except as set out in the Terms, and to the extent permitted by applicable law, OMNI is not involved in the actual transaction between Merchant and Buyers. You use the Services, the Platform and Merchant Portal at your own risk.

    2. The Services provided by OMNI (or its designated providers) under these Terms is General Services ("General Services") that consisting of:

      • providing supporting services of listing and publishing your Business in the Platform
      • limited Buyer care services, including coordinating and answering Buyer enquiries
      • other services ancillary to the Services.

      The General Services include OMNI providing information to you in relation to each Transaction as necessary under these Terms. You agree that OMNI may provide you with electronic copies of documents such as tax invoices, receipts, credit notes, debit notes, or any other documents for compliance with applicable laws; and

    3. OMNI charges a fee for all successful transactions completed by Sellers on the Site (“OMNI Commission Fee”). The OMNI Commission Fee is borne by the Merchant, and is calculated as TEN percent (10%) of the Total Settlement Price, rounded up to the nearest cent. The Total Settlement Price for a Transaction is the Buyer’s Purchase Monies for that item, plus any OMNI rebate, voucher and/or coins applied to such item by the Buyer.

    4. Following the successful completion of a transaction, OMNI shall deduct the OMNI Commission Fee and from the Buyer’s Purchase Monies, and remit the balance to the Merchant. OMNI shall issue receipts or tax invoices for the OMNI Commission Fee.

OMNI MALL

Omni Mall is a online marketplace by Omni Street where Buyers will be able to enjoy the rights and privileges described in these Omni Street Terms and Conditions (“Terms”) when purchasing items on Omni Mall from any participating Sellers. If you are a Buyer, you will be deemed to have consented to these Terms when you make purchases on Omni Mall. Similarly, if you are a Seller, you will be deemed to have consented to these Terms by your continued participation in Omni Mall. These Terms supplement all other Omni Street Policies.

  1. Omni Mall Refunds and Return Policy
    1. Buyer may apply for a refund and/or return of a Product purchased on Omni Street by completing the Return/Refund request in “Me > My Purchase” page. Seller and/or Omni will either approve or reject a Return/Refund request based on a valid return reason and additional feedback given by customer when initiating a Request - buyer may dispute the decision if buyer do not agree with the decision. The return validity is within fourteen (14) calendar days starts from the date Buyer received delivery of the Product; however, if Buyer did not receive the Product because of Buyer’s absence from the destination address or Buyer’s failure to input the proper destination address, that date would be the date on which delivery attempt was first made.

    2. Please note that Buyer must ship the Product to a location designated by Seller within three (3) days after the return request is raised and approved. When returning the Product, Buyer must affix or otherwise include the Return Air Waybill. The Return Air Waybill will be contained in the Product package delivered to Buyer. The Return Air Waybill will also contain the return address to which the Product must be returned. All Products that are returned must be returned via Pos Laju or a courier designated by Seller by no later than the last day of the Free Return Period. Seller reserves the right to reject any application where the Return Air Waybill was completed after the Free Return Period or the Product was dispatched later than seven (7) days after the return request is raised (even if the Return Air Waybill was timely completed).

    3. The approval of your request for refund and return will be made by Seller in its sole discretion after reviewing your completed Return Air Waybill and inspecting the condition of the Product that was returned. The Product that was returned to Seller must be, at a minimum, in the following conditions:

      • New and sealed condition;
      • Complete, with all items included in the purchase; and
      • With original product packaging and price tags.
      If any additional conditions apply to a certain Product, Omni Street will inform you via the Site, SMS, Whatsapp or email. The conditions for the Products subject to return are referred to as the “Return Conditions”.

    4. In addition, please note that certain types of Products may be excluded from the Refunds and Return Policy described in these Terms, including:

      • Digital goods, such as mobile top-up cards, audio or video recording or software;
      • Goods that are perishable or may otherwise deteriorate or expire rapidly, such as groceries; and
      • Goods that are not suitable for return due to health protection or hygienic reasons, such as earrings, cosmetics, swimwear, undergarments; and
      • Items sold by non-Omni Street sellers.
      If any Product is excluded from the Refunds and Return Policy described in these Terms, Omni Street will make reasonable efforts to publish that information on the Site or otherwise inform the Buyers; however, please note that our policies may change without notice at any time and certain Products may be subject to exclusion after Buyer has purchased them. Any Product that is subject to exclusion from the Refunds and Return Policy described in these Terms is referred to as an “Excluded Item”.

    5. Omni Street reserves the right to (a) add to or otherwise amend the list of Excluded Items and/or the Return Conditions and (b) amend, terminate or suspend the Refunds and Return Policy described in these Terms (including the length of the Free Return Period), in each case, at any time at its sole discretion.

    6. Seller may reject in its sole discretion any returned Product (and the related request for refund and return):

      • that is an Excluded Item;
      • that does not meet the Return Conditions;
      • if the Return Air Waybill relating to such returned Product was completed after the expiration of the Free Return Period; or
      • if the Product was returned in a manner that does not comply with Section 1.2 above.
      Please note that Seller’s determination will be based on the list of terms of conditions in effect at the time of such determination (including the list of Excluded Items, the Return Conditions and the Free Return Period), and therefore pursuant to Section 1.5 above, such list of Excluded Items, the Return Conditions and/or the length of Free Return Period may be different from those in effect at the time Buyer has completed the Return Air Waybill and/or returned the Product.

      If Seller rejects a request for refund and return, Seller will organize the delivery of such Product to the relevant Buyer’s address to which the Product was originally delivered, and Seller shall be entitled to seek compensation from such Buyer for any costs incurred in delivering the Product back to such Buyer.

    7. Omni Street reserves the right to terminate a Buyer’s access to Omni Street if it suspects any abuse of the Refunds and Return Policy described in these Terms, if Omni Street deems appropriate, may also impose penalties (including recovery of any fees or charges incurred as a consequence of such abuse).

  2. Omni Mall Seller Terms and Conditions
    1. If you are a Seller, you should have received a separate written notification from Omni Street informing you of your selection to participate in Omni Street. If you decide not to participate in Omni Street at any time, please inform Omni Street in writing (refer to the contact info in the end of this Terms and Conditions); otherwise, you will be deemed to have elected to continue your participation in Omni Street and consented to the terms and conditions set out in these Terms.

    2. Each Seller undertake, represent and warrant that the Product(s) it offers on Omni Street and actually delivered to Buyer are

      • the Products are of merchantable quality, fit for their purpose, free from defects, and conform to their listed specifications;
      • the Products and their offer for sale are not prohibited and comply with applicable laws (including all minimum age, marking and labelling requirements, product warranties, specifications and performance criteria) and conform with the Policies;
      • you will include all legally required documentation in relation to the Products (including warranty card, warranty information and invoice) and update the same when legally required, and shall provide Omni Street and/or Buyer any such document upon request;
      • you have full unencumbered title in the Products and in any materials incorporated in the Products and all the Products are supplied free of all liens, charges or other security interests;
      • the Products are not
        • Prohibited and Controlled Products;
        • Inadequate Product;
        • expired (or soon to be expired) Products; or
        • counterfeit Products;
      • you shall provide Omni Street with any documentation and information supporting your right to sell the applicable Products, including the right, license and/or permit to sell such Products, any documentation giving you the right to distribute the Products, and if needed, the notarized copy, invoice or other proof thereof at your cost;
      • in case of sale of refurbished Products, imported Products, white label Products, or non-OEM Products, you must comply and strictly follow Omni Street ’s specific content requirements and the specific guidelines defined for such Products on the content production manuals; and
      • you shall comply with standard operating procedures, import procedures, weight restrictions, size restrictions and other shipping and packaging requirements under the Policies and/or applicable law.

      Each Seller understands and agrees that it will be responsible for any non-conformity or defect in, or any public or private recall of, any of Items, and will hold Omni Street harmless from any losses relating to the foregoing.

    3. If you are found to have offered or sold any Product on Omni Street that violates the aforementioned, Omni Street reserves the right to, at its sole discretion, remove the offending Product(s) from Omni Street , and execute refunds (and any adjustments) to Buyers who have purchased such Product, in which case Seller agrees to reimburse Omni Street for all such refunds (including any related costs and charges) and authorises Omni Street to deduct such amounts from any amounts payable to you or take such other action as deemed appropriate by Omni Street at its sole discretion.

  3. Omni Street 100% Authentic Product Policy
    1. All products listed by Sellers must be 100% authentic.

    2. Counterfeit products are prohibited from being listed in Omni Street. The term “counterfeit” encompasses a product that was made in exact imitation of an existing brand with the intention to deceive or defraud and may include, but is not limited to:

      • A product that violates any local country laws in which they are sold;
      • A product that is a fake or a replica of an existing official product;
      • A product that has never been produced by a specific brand;
      • A product that is significantly under-priced;
      • A product containing a registered trademark on the product, the packaging or anywhere related to the product without the authorisation of the trademark owner;
      • A product that contains specific design elements (e.g. cartoon characters or colourways) protected by a trademark; without the authorization of the trademark owner;
      • A product that bears such similarities with other products (e.g. a replica of a branded item with or without altered logos) without the authorization of the trademark owner;
      • A product that has no visible trademark on the product image on the listing, but the delivered product includes a trademark; and
      • Usage of a photo on the listing that contains the trademark of a brand.

    3. Original equipment manufacturer (“OEM”) brands are permitted as long as no official brand logo is displayed on any OEM product image and no official brand name is stated in any part of the product information.

    4. If requested by Omni Street , the Seller shall promptly provide documentation to Omni Street that proves (to Omni Street’s reasonable satisfaction) the authenticity of the Product including, but not limited to, manufacturer sales invoices, authorized distribution agreements and/or certificates of authenticity (“Proof of Authenticity”).

    5. If the Seller fails to provide Proof of Authenticity, the Seller shall:

      • accept the return of the Product from the Buyer;
      • refund to the Buyer the amount that the Buyer paid for the Product or, where Omni Street has already refunded this amount to the Buyer, the Seller shall refund such amount to Omni Street;
      • be liable to compensate Omni Street for such other costs, expenses, losses and liabilities suffered or incurred by Omni Street (including, but not limited to, loss of goodwill) as determined at Omni Street’s sole discretion.

    6. In the event that Omni Street determines, at its sole discretion, that Seller has violated Section 3, Omni Street may take all appropriate measures, including but not limited to removing the counterfeit Product listing from the Site, prohibiting the publication of the same or similar goods and/or restricting, suspending or terminating the Seller's Omni Street account and/or access to Omni Street. Seller's obligations and liabilities under these Terms will not be affected by the restriction, suspension or termination of the Seller’s account.

  4. Omni Street Services & Fees
    1. Omni Street provides a platform for Sellers to offer Products for sale to Buyers, and for Sellers to complete transactions with Buyers. Except as set out in the Terms, and to the extent permitted by applicable law, Omni Street is not involved in the actual transaction between Seller and Buyers nor is Omni Street obliged to verify the accuracy, completeness and legality of the Seller Content published on the Platform. As vendor of the Products, it is your responsibility to ensure the sale is legal, accurately describe the Products, and the Products are packaged, shipped, warranted and fulfilled in respect of all sale and after sale obligations required by law or by trade. You use the Services, the Platform and Seller Center at your own risk.

    2. The Services provided by OMNI (or its designated providers) under these Terms is General Services ("General Services") that consisting of:

      • providing supporting services enabling your listing and publishing of Seller Content regarding the Products you offer for sale on the Platform;
      • providing the Platform for you to offer Products for sale;
      • limited Buyer care services, including coordinating and answering Buyer enquiries and processing returns;
      • Order processing;
      • collection, reconciliation and execution of all Sales Proceeds; and
      • other services ancillary to the Services.

      The General Services include OMNI providing information to you in relation to each Order as necessary under these Terms. You agree that OMNI may provide you with electronic copies of documents such as tax invoices, receipts, credit notes, debit notes, or any other documents for compliance with applicable laws; and

    3. OMNI charges a fee for all successful transactions completed by Sellers on the Site (“OMNI Commission Fee”). The OMNI Commission Fee is borne by the Seller, and is calculated as THREE percent (3%) of the Gross Settlement Price, rounded up to the nearest cent. The Gross Settlement Price for a Product is the Buyer’s Purchase Monies for that item, plus any OMNI rebate, voucher and/or coins applied to such item by the Buyer. For the avoidance of doubt, the categorization of a product shall be at OMNI’s sole and absolute discretion.

    4. Following the successful completion of a transaction, OMNI shall deduct the OMNI Commission Fee and the Payment Gateway Fee from the Buyer’s Purchase Monies, and remit the balance to the Seller. Omni Street shall issue receipts or tax invoices for the OMNI Commission Fee and Payment Gateway Fee.

OMNI PAY

These Terms and Conditions govern your access and use of the OMNI virtual Pay ("Omni Pay").

Omni Pay is powered by Fass Payment Solutions Sdn. Bhd. (“Fasspay”) for Omni Street Sdn. Bhd. (“OMNI”).

By requesting and/or using Omni Pay, the User agrees to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use Omni Pay.

  1. Access to Omni Pay
    1. User agrees to:

      • use Omni Pay only for lawful purposes and in a lawful manner at all times and further agree to conduct any activity relating to Omni Pay in good faith;
      • comply with any and all guidelines, notices, operating rules, and policies and instructions pertaining to the use of the Omni Pay, as well as any amendments thereto issued by us from time to time; and
      • ensure that any information or data user provide to OMNI in connection with the Omni Pay is accurate.

    2. It is OMNI policy to prohibit and actively pursue the prevention of money laundering and any activity that facilitates money laundering or the financing of terrorist or criminal activities. We are committed to anti-money laundering compliance in accordance with applicable law and requires our directors, officers and employees to adhere to these standards in preventing the use of our products and services for money laundering purposes.

    3. Use of the Omni Pay is restricted to registered users of the OMNI Platform.

    4. By using Omni Pay, you agree to comply with all applicable laws and regulations in Malaysia, including not undertaking or engaging in any dealing or transaction with the State of Israel, its residents or any entity owned or controlled, directly or indirectly, by the State of Israel or its residents including any authority or agency of the State of Israel.

  2. Registration
    1. The registration process for the Omni Pay Account requires you to provide OMNI with accurate and complete personal information, which may include your name, national registration identity card or passport number, address, telephone number, date of birth, email address, nationality and any other information as may be deemed necessary by OMNI ("Registration Information"). You shall be responsible to update the Registration Information to ensure its completeness and accuracy.

    2. In addition to such Registration Information, we may request for additional information or documentation at any time and for any reason, including confirming user identity, age and/or to confirm user bank details or debit, credit, prepaid facilities, for example, cards which user have registered with us. User agree will provide such information and/or documentation promptly to OMNI upon request. If user do not provide such information and/or documentation promptly, OMNI may, without any liability to user, either limit User use of the Omni Pay or suspend or close your Omni Pay account.

    3. User authorize OMNI to make any enquiries OMNI consider necessary to validate and verify user identity (whether directly or through third parties) at any time for any reason whatsoever, including making any enquiries on behalf of OMNI to process any refunds.

    4. User agree that User shall be allowed to register and maintain only one (1) Omni Pay account.

    5. User solely responsible for keeping the Omni Pay username and password secure. User is encouraged to change password on a regular basis and OMNI will not be liable for any disclosure or unauthorised use of OMNI username or password. If username or password has been compromised, user must inform OMNI immediately.

    6. All Personal Data provided to OMNI will be handled, stored, and processed according to our Privacy Policy. By accepting these Terms and Conditions, you acknowledge that you have read and agree with the Privacy Policy and consent to our collection, use and disclosure of your Personal Data for the purposes as set out in the Privacy Policy.

  3. Omni Pay Type, Balance & Functions Type
    1. You may maintain funds in your OMNI Pay, and such funds, less any monies owed to us, will be regarded as the balance of your OMNI Pay ("OMNI Pay Balance").

    2. The following limits will apply to your OMNI Pay (without Standard CDD Checks):

      • OMNI Pay Limit: Ringgit Malaysia 200 (RM200);
      • OMNI Pay Per Transaction Limit: Ringgit Malaysia 200 (RM200);

    3. Funds can be accumulated in your OMNI Pay Balance by means of a transfer of funds from certain payment instruments we accept (including credit cards, debit cards, banking account or other payment method we allow, collectively, "Payment Instruments").

    4. For any transfer from a Payment Instrument to your OMNI Pay Balance, we make no representation that any of your Payment Instrument(s) are in good standing, or that the issuer of your Payment Instruments will authorise or approve such transfer.

    5. Unless otherwise stated, both you and OMNI are not liable for any fees raised by third parties including card issuers or banks, associated with funding your OMNI Pay Balance. However, we reserve the right to decline acceptance of any payment instruments, including credit cards, debit cards or bank accounts, as funding methods at our sole discretion.

    6. We reserve the right to impose limits on your use of OMNI Pay from time to time, including (i) the amount of value you may load your OMNI Pay at any one time; and (ii) the aggregate funds loaded to your OMNI Pay over any time period.

    7. Details relating to the use of your OMNI Pay including transactions made and balance remaining in your OMNI Pay can be found on the OMNI Platform.

  4. OMNI Pay Usage
    1. You may use your OMNI Pay to purchase goods and/or services through the OMNI Platform: Omni Store and Bill Payment & Reload. For security reasons, we may limit the amount or number of transactions you can make through your OMNI Pay. We may require that you submit additional identification documents prior to you making a purchase at our sole discretion.

    2. Each time you use your OMNI Pay, you authorize us to reduce the value available in your OMNI Pay Balance by the total amount of the transaction and where applicable, any fees, including shipping fees, payment fees, and all applicable taxes. You can only make payments using your OMNI Pay to the extent that you have OMNI Pay Balance to support those transactions. You are not allowed to make purchases in excess of your OMNI Pay Balance. We will not extend credit in connection with your use of your OMNI Pay, and you must repay us immediately if your OMNI Pay Balance is ever less than zero for whatever reason.

    3. You are responsible for all transactions initiated and fees incurred by using your OMNI Pay. If other persons access your OMNI Pay, we will treat this as if you have authorized such use and you will be responsible for any transactions made and fees incurred by such use.

    4. You must notify us immediately of any unauthorized use of OMNI Pay or any other breach of security regarding the OMNI Pay of which you have knowledge. You must report any such activities within ninety (90) days for any claims for unauthorized use of your OMNI Pay to be valid for consideration under Payment Protection Policy.

    5. You shall ensure that you download the OMNI Mobile Application from the authorized Apple App Store or Google Play from the authorized application store.

    6. For access and usage of OMNI Pay via the OMNI mobile application you must ensure that you shall not install or use the mobile application on a jail-broken or rooted device. Unauthorised modifications to any mobile devices’ operating systems can cause security issues to the hacked devices. We shall not be liable for any losses suffered by you or for any costs that you might incur due to damage or corrupted or failure of device, hardware or software that you use in connection with the mobile application.

    7. Notwithstanding anything to the contrary under Payment Protection Policy, you agree that we will not compensate you for any loss resulting from any claims for unauthorized use of your OMNI Pay under any of the following events, as determined at our sole and absolute discretion:

      • where any such claims relate to transactions that are found to be conducted on your trusted device, your IP address or any other user‐acceptable boundaries;
      • where you have acted fraudulently or with negligence, including but not limited to cases where you have wilfully disclosed your OMNI Pay log-in details to a third party;
      • if you fail to provide us with any relevant documentation as reasonably requested by us in relation to any such unauthorized transactions;
      • where any funds in your OMNI Pay are subject to legal process or other encumbrance restricting transfer;
      • where any such transactions are took place under circumstances beyond our control, including but not limited to natural disasters, civil unrest etc. which are beyond reasonable control; and/or
      • where any terminal or system (including our or OMNI’s website or services) was not working properly or suffering any other technical malfunction before you initiated the relevant transaction.

    8. We shall have the right to refuse any transaction on your OMNI Pay if:

      • the transaction does not satisfy these Terms and Conditions or the terms and conditions of your OMNI Account; or
      • where we have reason to believe that the transaction may violate any laws, rules or regulations or may otherwise subject us or any of our affiliates to liability or obligation.

    9. When using your OMNI Pay to pay for a purchase on the OMNI Platform, payments may be processed through accounts owned by us or one of our affiliates and/or a registered third party service provider acting on our behalf.

    10. If you experience any difficulties with your OMNI Pay, please contact us at the details stated at the end of this Terms and Conditions.

    11. You agree to give all notices, provide all necessary information, materials and approvals, and render all reasonable assistance and cooperation necessary for us to operate your OMNI Pay. If your failure to do so results in any delay in any transaction on your OMNI Pay, neither we nor OMNI shall be liable for any loss or damages arising from such delay.

    12. You acknowledge and agree that we are not a bank or remittance agent and the services we provide to you in connection with your OMNI Pay should in no way be construed as the provision of banking services or remittance services. We are not acting as a trustee, fiduciary or escrow with respect to your OMNI Pay Balance.

  5. Withdrawal
    1. You may withdraw your OMNI Pay Balance to your local bank account via OMNI Platform. A minimum of RM10 is required for withdrawal request and every withdrawal is imposed for a RM2 service fee.

  6. Closure and Non-Use of Omni Pay
    1. You may request that we close your OMNI Pay at any time by contacting our customer support team. Contact details is stated at the last of this Terms and Conditions.

    2. We may, at any time and at our absolute and sole discretion:

      • discontinue your use of the OMNI Pay or any part thereof;
      • close your OMNI Pay; and/or
      • reactivate your OMNI Pay upon the completion of any relevant internal investigations (where applicable).

    3. We shall endeavour to provide notice of any such discontinuation or closure of your OMNI Pay. You agree that we shall not be liable to you in relation to any inability of yours to access your OMNI Pay or any part thereof.

    4. Closure of your OMNI Pay will not cancel any cleared transactions, which you have already undertaken.

    5. You remain liable for all obligations related to your OMNI Pay. Closure of your OMNI Pay does not relieve you of any liability pertaining to your OMNI Pay. In the event of a pending investigation at the time your OMNI Pay is closed, we may continue to hold your funds for up to one hundred and eighty (180) days from the date of closure in order to protect us against any loss. If we suspect that you have used your OMNI Pay for any illegal purposes, we may hold any outstanding OMNI Pay Balance for such time as we determine in our absolute discretion or as required by law.

    6. We have the right not to return to you any disputed funds or any funds which relate to a breach of these Terms and Conditions until such time such a dispute has been resolved or where a court of a competent jurisdiction has decided on the matter.

    7. We reserve the right to carry out any necessary money laundering, terrorism financing, fraud or any other illegal activity checks before authorizing any withdrawal of your funds, including returning any funds to you after your OMNI Pay has closed or before any refunds are processed.

  7. Restricted Activities
    1. In connection with your use of your OMNI Pay, you shall not:

      • Provide false, inaccurate or misleading information;
      • Use your OMNI Pay for any illegal activities;
      • Use your OMNI Pay in a manner that may result in complaints, disputes, claims, penalties or other liability to us, other users or third parties or may be regarded as an abuse of the card system or a violation of card association or network rules; or
      • Breach these Terms and Conditions and/or the Privacy Policy or violate any applicable laws and regulations.

    2. If you are below 18 years old you must obtain consent from your parent(s) or legal guardian(s). By consenting to your acceptance of these Terms and Conditions, your parent(s) or legal guardian(s) are agreeing to take responsibility for: (i) your actions in your use of the OMNI Pay; (ii) any charges associated with your use of any of the OMNI Pay; and (iii) your compliance with these Terms and Conditions. If you do not have consent from your parent(s) or legal guardian(s), you must cease using the OMNI Pay.

BILL PAYMENT AND RELOAD
  1. The following Terms and Conditions apply to the availment of the bills payment services (including mobile top-ups and bill payments for prepaid and postpaid services) provided and managed by third party aggregators, utility or phone companies and/or billers ("Third Party Biller"), and made available on OMNI’s websites, mobile applications and in-application stores ("Bills Payment Services"). By availing of the Bills Payment Services, a customer/user ("Customer") agrees unconditionally and irrevocably to be bound by, and shall be deemed to accept, these Terms and Conditions in addition to the OMNI Terms and Conditions.

  2. The Customer acknowledges that the Bills Payment Services are provided and managed by Third Party Billers. Accordingly, the bill payment transactions and agreements are entered directly between the Customer and Third Party Billers.

  3. Bills payments will be made by the Third Party Billers according to the information provided by the Customer. The Customer shall be responsible for any errors in any information given, such as but not limited to bill details, account name, and amounts. The Customer shall check carefully before payment, as the transactions are non-cancellable and non-refundable once payments are made.

  4. The Customer should note that in very exceptional situations, there could be cases of failed payments due to technical glitch, and therefore the Customer should pro-actively check payment status; in cases of failed payments, the Customer should take steps to make the relevant payments promptly again to avoid late payment charges imposed by Third Party Billers.

  5. The Customer agrees that he/she will not be furnished with printed receipts from the Third Party Billers. Transaction reference numbers, however, will be provided.

  6. OMNI reserves the right to cancel, reject the order and/or recover monies paid to Third Party Billers (where applicable) if the Customer failed to comply with these Bills Payment Terms and Conditions, or if OMNI determines in its sole discretion that the order was made under suspicious circumstances, with fraudulent intent, or in relation to any illegal activity.

  7. If any excess monies have been paid to the Third Party Billers by OMNI or its payment service provider (compared to what was paid by Customer), OMNI reserves the right to recover from the Customer such amounts.

  8. These Terms and Conditions, the Bills Payment Services, as well as associated fees, charges and requirements (if any), may be subject to change without further notice.

  9. By availing of the Bills Payment Services and providing their personal information, the Customer consents to the transmission, transfer or processing of said information as may be deemed necessary or appropriate to perform the bills payment services referenced herein. The Customer likewise acknowledges and agrees to OMNI’s Privacy Policy as applicable from time to time.
